Bob Boemer, Lee Wertz, and Carrie Schadle argued successfully to a Brazoria County judge that he should dismiss all claims against their client, Waste Management. The $39 million dollar law suit arose out of a 2002 railcar explosion that caused extensive damage to portions of a BASF facility in Freeport, Texas. They argued that Waste Management could not be held liable for causing the damages resulting from the catastrophic rupture of a chemical waste-filled railcar that BASF and another subcontractor were in the process of emptying, without any aid or input from Waste Management. The court agreed and ruled from the bench that all claims asserted against Waste Management should be dismissed.
